Article 1: Definition of Terms

These general terms and conditions of sale and use are concluded, on the one hand, between “THE SELLER”, Mrs. Lucille Fosse, Sole Proprietor registered with the Chamber of Trades and Crafts of Loire Atlantique under the number 98244785600013 and manager of the “SITE” www.maisonluciole.com, and on the other hand, any individual or legal entity wishing to make a purchase via the website www.maisonluciole.com, hereinafter referred to as “THE BUYER”.


Article 2: Purpose

The purpose of these general terms and conditions of sale is to define the contractual relationship between the seller and the buyer and the conditions applicable to any purchase made through the website www.maisonluciole.com.

The acquisition of a product through this site implies an unreserved acceptance by the buyer of these terms and conditions of sale, of which the buyer acknowledges having been aware prior to placing an order.
Before any transaction, the buyer declares that the purchase of products on the website www.maisonluciole.com is not directly related to their professional activity and is limited to strictly personal use, and that they have full legal capacity to engage under these general terms and conditions of sale.
The seller reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of their site. Therefore, the applicable conditions will be those in effect on the date of the order by the buyer.

Article 3: Products

The products offered are those listed on the website www.maisonluciole.com within the limits of available stocks. The seller reserves the right to change the product assortment at any time.

All jewelry offered on the site www.maisonluciole.com is handmade by the designer Lucille Fosse in unique pieces or small series. Therefore, some pieces from the same series may have slight differences or small irregularities that cannot be considered by the buyer as non-conformity defects. Some of the jewelry offered on the site is made of raw brass and may, therefore, oxidize and change color over time. This natural oxidation cannot be considered a non-conformity defect by the buyer. Each product is presented on the website with a description of its main characteristics. The photographs are as accurate as possible but are not binding on the Seller.

The sale of products presented on the site www.maisonluciole.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory. The costume jewelry sold on the site www.maisonluciole.com are not toys and are not suitable for children under 36 months.
The creations on the site www.maisonluciole.com are the property of the designer of the brand Maison Luciole, Lucille Fosse. Any reproduction is prohibited.


Article 4: Gift Cards

The gift cards offered for sale on the site can only be used on the online store www.maisonluciole.com. The gift cards are purchase vouchers with a defined amount at the time of the order ranging from 25 to 120 euros. The buyer has the option to personalize their voucher with the recipient’s name by entering it in the “Order Notes” section just before proceeding with the payment.

The vouchers are delivered by email to the address provided when creating the customer account or placing the order, in PDF format within 48 hours after order validation. The seller cannot be held responsible for any technical incident occurring on the buyer’s network preventing the retrieval of the file within the given time frame.

The vouchers are valid for 12 months from their date of issue and cannot be exchanged in case of loss, theft, or expiration, nor can they be refunded, even partially, in case of a purchase amount lower than that indicated on the voucher. They can be combined with each other but cannot be combined with discount codes from current promotional offers except for sales or reduced product prices displayed on the site. They must be used in one go and can be supplemented by another payment method in case of a purchase exceeding the voucher amount.

Article 5: Prices

The prices listed on the product sheets on the website are in Euros (€), including all taxes (VAT included). VAT is not applicable according to article 293 B of the CGI.

The seller reserves the right to modify their prices at any time, but the price listed in the catalog on the day of the order will be the only price applicable to the buyer.

Prices do not include handling, shipping, transport, and delivery costs, which are charged in addition, under the conditions indicated on the site and calculated prior to the order. The payment requested from the Client corresponds to the total amount of the purchase, including these fees. An invoice is issued by the Seller and given to the Client upon delivery of the ordered Products.

Article 6: Order and Payment Terms

Before placing any order, the buyer may create an account on the website www.maisonluciole.com. The account creation section is directly accessible from the top menu bar. During each visit, the buyer, if they wish to order or consult their account (order status, profile, etc.), will need to identify themselves using their information.

The seller offers the buyer the option to order and pay for their products in several stages, with secure payment by credit card (via Stripe) or PayPal. The buyer selects the products they wish to order in the “cart,” modifies if necessary (quantities, references, etc.), verifies the delivery address, or provides a new one. Then, the shipping costs are calculated and submitted to the buyer, along with the carrier’s name.

Next, the buyer chooses their preferred payment method: “Credit card payment” or “PayPal payment.” The next step invites them to verify all information, acknowledge and accept these general terms and conditions of sale by checking the corresponding box, and then validate their order by clicking the “Confirm my order” button.
Finally, the buyer is invited to provide their banking details or is redirected to the secure PAYPAL interface to securely enter their PayPal account details. If the payment is accepted, the order is recorded, and the contract is definitively formed.

The confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgment of having full knowledge of them, and the waiver of invoking one’s own purchase conditions. All the data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on their order form, the seller will send them an email confirmation of the order registration.
In case of unavailability of a product after payment, a full refund of the amounts paid will be made by the seller.

Article 7: Delivery

Products are deliverable in mainland France, within the European Union, and internationally. Deliveries are made to the address specified on the order form, which must be within the agreed geographical area. Orders are shipped by La Poste via tracked letter or Colissimo.

Orders placed on the site will be shipped within a period ranging from 48 hours to a maximum of 10 working days after validation, and delivery times vary depending on the transport mode chosen by the buyer. The risks related to transport are borne by the buyer from the moment the items leave the seller’s premises. The buyer is required to check, in the presence of the postal worker or the delivery person, the condition of the packaging and its contents upon delivery. In case of damage during transport, any complaint must be made by the customer to the carrier within three days of delivery.


Article 8: Withdrawal

Under article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return shipping costs.

The item must not have been worn or damaged and must not show any signs of wear. It must be returned in tracked mail in its original intact packaging to the address below and sufficiently protected to avoid damage during transport. Photos of the inside and outside of the packaged parcel must be sent by email to EricJean-Jacques@outlook.fr before shipping it.

The refund will then be credited back to the credit card, PayPal balance, or bank account used when placing the order, no later than 14 working days after receipt and verification by the seller.

Article 9: Retention of Ownership

The seller retains full and complete ownership of the products sold until the full price is collected, including the principal, fees, and taxes.

Article 10: Warranty

All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it, or refund it.

Article 11: Liability

The seller, in the process of distance selling, is only bound by an obligation of means. Their liability cannot be engaged for damage resulting from the use of the Internet such as data loss, intrusion, viruses, service interruption, or other unintentional problems.

Article 12: Intellectual Property

All elements of the site www.maisonluciole.com are and remain the intellectual and exclusive property of Lucille Fosse. No one is authorized to reproduce, exploit, or use, in any capacity, even partially, elements of the site, whether in the form of photo, logo, visual, or text.

Article 13: Personal Data

The seller undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning them is subject to the provisions of the law no. 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify, and delete information concerning them. Article 14: Dispute Resolution

For any complaint, please contact the Maison Luciole customer service at the postal address indicated or via the contact form available on the site.
The client is informed that they can, in any case, resort to conventional mediation, with sectoral mediation bodies existing or any alternative dispute resolution method in case of a dispute.
The designated mediator is CM2C.
Before referring to a mediator, the buyer must justify having exhausted all other remedies to resolve the dispute with the seller. Written documents, such as the complaint, email exchanges, or copies of the contract concerned by the dispute, must thus be provided. Without an amicable agreement, the mediator must be contacted within a maximum of one year following the complaint.
